Subject to the terms of the Privacy Policy governing the use of the Website and the Company’s programs/services, if applicable, when the User submits messages, data, text, photographs, images, and other materials to the Company, the User grants the Company a worldwide, irrevocable, non-exclusive, perpetual, and royalty-free license: i) to use, reproduce, store, adapt, translate, modify, create derivative works from, transmit, distribute, or make such content available to the public for any purpose whatsoever; and (ii) to sublicense to third parties the unrestricted right to exercise any of the aforementioned rights. In addition to granting the aforementioned license, but subject to the terms of the Privacy Policy regarding the use of the Website and the Company’s programs/services, if applicable, which take precedence, the User hereby: i) waives all moral rights in their content; ii) consents to the display of their name and address in connection with such content, if applicable, as well as to the disclosure or posting of such information; iii) acknowledges and agrees that the Company shall not be liable for any loss, damage, or corruption of the User’s content; and iv) acknowledges and agrees that any submissions the User transmits for posting on the Website or submits to the Company shall be deemed non-confidential.

The User declares and guarantees to the Company that: (i) the User’s content is original; (ii) the User’s content does not infringe any intellectual property rights, including, without limitation, copyright; (iii) the User is the sole owner of all intellectual property rights, including, without limitation, copyright, in the User’s content, or, if applicable, the User has obtained written permission from the rights holder to submit the User’s content; iv) the User’s content does not infringe upon any third party’s right to privacy or right of publicity; v) the User’s content is truthful, accurate, up-to-date, and complete to the best of their knowledge; vi) the User’s content is not illegal; vii) the User’s content does not contain defamatory or insulting statements.

The Company has no obligation to review content stored on or transmitted through its Website. The User acknowledges, however, that the Company may review such content at any time, particularly to comply with any law, regulation, decree, or request from the authorities; to ensure the proper functioning of the Website; or for any other reason at its sole discretion. The Company reserves the right to modify, refuse, or remove any Content stored on its Website or transmitted thereto if the Company determines, in its sole discretion, that such Content violates these Terms of Use.

Integrity and Accuracy of Information and Access to the Website

The Company reserves the right to change the listed prices at any time and without notice. Taxes and shipping costs are not included in the listed prices. All listed prices are in Canadian dollars. Although the Company strives to be as accurate as possible, the price of a product listed on the Website may be inaccurate. If the price displayed for a product on the Website is inaccurate, the Company reserves the right to either correct the price or cancel a sale made on the Website, at its discretion.
